The following General Terms and Conditions apply to all orders placed via the online shop https://leight.at of Dr Leidl GmbH, Landstraßer Hauptstraße 88/25, 1030 Vienna, hereinafter referred to as the shop operator, the following General Terms and Conditions apply:
1 Conclusion of contract
All deliveries and services from the above-mentioned online shop through orders via the Internet are subject to these General Terms and Conditions. Deviating and/or supplementary agreements require the express consent of the shop operator. With the publication of the individual products, we submit a binding offer for the articles. By clicking on the order button, the customer places a binding order for the goods contained in the shopping basket. Confirmation of receipt of the order is sent together with acceptance of the order after the order has been sent by means of an automated e-mail message. With this confirmation by e-mail, the purchase contract is legally binding. Deliveries are only possible to delivery addresses in Austria and some EU countries.
2 Online orders
Incoming online orders are processed immediately by the shop operator and dispatched as quickly as possible depending on the availability of goods.
3 Transport/transport damage
Complaints caused by transport damage must be made by the customer directly to the transport company within the deadlines provided for this purpose and the customer must also inform the shop operator. The customer's e-mail address provided when placing the order will be communicated to the transport company when the parcel is handed over in order to ensure added value for the customer during delivery. The transport company in turn informs the customer about the parcel status and the planned delivery time using the e-mail address, whereby the customer can also change the delivery address and delivery time at a later date. Parcels are currently usually sent by Austrian Post. In order for the customer to be able to claim transport damage, the recipient must always photograph the parcel together with the goods and filling material. A photo of the damaged goods alone will not be recognised by Austrian Post and/or other delivery services for claims. In the event of damage, the customer should take the parcel, consisting of goods and filling material, to the nearest post office and have the damage recorded.
3.1 Passing of risk
The transfer of risk shall pass to the customer as soon as the object of performance is handed over to the transport company or the person or institution otherwise designated to carry out the dispatch or has left the shop operator's warehouse for the purpose of dispatch. This shall also apply if the shop operator has assumed the shipping costs or the delivery or if partial deliveries are made.
4 Invoices and payments
Invoices are due immediately and without any deductions. The payment options are shown in the online shop.
5 Objections
Any complaints regarding the scope of delivery, material defects, incorrect deliveries and quantity deviations must be made in writing immediately, but at the latest within one week of receipt of the goods. In the event of justified complaints, the shop operator shall make subsequent deliveries and, at the discretion of the customer, exchange or take back the unopened, originally packaged and undamaged goods subject to reservation. If the second replacement delivery is also defective in the event that the goods are exchanged, the buyer shall be entitled to cancellation or reduction of the purchase price.
6 Ownership and object of purchase
The object of purchase remains the property of the shop operator until full payment has been made. For the duration of the retention of title, the buyer shall be entitled to possess and use the object of purchase in accordance with the contract as long as he/she fulfils his/her obligations arising from the retention of title and his/her obligations arising from the business relationship in due time. The customer undertakes vis-à-vis the shop operator to provide all information required in the context of pursuing rights arising from the agreed retention of title.
7 Failure to accept the goods
Ordered and not accepted goods entitle the shop operator to withdraw from the contract. The customer accepts the order conditions of these General Terms and Conditions by sending the order.
8 Cancellation policy
The customer has the right to cancel the contract within fourteen days without giving any reason. The cancellation period begins on the day on which the customer or a person named by the customer who does not work for the transport company takes possession of the goods. In order to exercise the right of cancellation, the customer must inform Dr. Leidl GmbH, Landstraßer Hauptstraße 88/24, 1030 Vienna, e-mail address: office@leight.at, by means of a clear declaration (e.g. letter sent by post or e-mail),

To comply with the cancellation period, it is sufficient for the customer to send the notification of the exercise of the right of cancellation before the expiry of the cancellation period.
8.1 Consequences of the cancellation
If the contract is cancelled by the customer, all payments including the delivery costs (with the exception of the additional costs resulting from the fact that a different type of delivery than the cheapest standard delivery offered by the shop operator was chosen), which the shop operator has received to date, must be repaid immediately and at the latest within fourteen days from the day on which the notification of the cancellation of the contract was received. The same means of payment used for the original transaction shall be used for this repayment, unless expressly agreed otherwise. Under no circumstances will fees be charged for the repayment. The shop operator may refuse the refund until the goods have been returned or until proof has been provided that the goods have been returned, whichever occurs first. The customer must return the goods to Dr. Leidl GmbH, Landstraßer Hauptstraße 88/24, 1030 Vienna, immediately and in any case within fourteen days of the day on which he*she was informed of the cancellation of this contract. The deadline is met if the goods are dispatched before the expiry of the fourteen-day period. The customer shall bear the direct costs of returning the goods.
The owner will not bear any costs for returns sent carriage forward. The customer shall only be liable for any loss in value of the goods if this loss in value is due to an inspection of the condition, properties and functionality of the goods or to unnecessary handling of the goods.
9 Final provisions
The invalidity of individual provisions of these General Terms and Conditions shall not affect the validity of the remaining provisions. An ineffective provision shall be replaced by a new provision that comes as close as possible to the economic effect of the ineffective provision. All sales prices are quoted in euros and include VAT. Errors in product descriptions and product availability are excepted. All offers are subject to technical changes and other changes, such as changes in shape, colour and/or weight, which are reserved to the extent reasonable for the customer.
